§ 34-422. DEFINITIONS.

  • The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them.
    ALCOHOLIC LIQUOR. The same meaning given to it under Public Act 58 of 1998, being M.C.L.A. §§ 436.1101 et seq., as amended.
    CONTROLLED SUBSTANCE. The same meaning given to it under the Michigan Public Health Code, Article 7, M.C.L.A. §§ 333.1101 et seq., as amended.
    EMERGENCY RESPONSE.
    (1) The providing, sending and/or utilizing of public services, police, firefighting, and/or rescue services by the city for an accident involving a motor vehicle where 1 or more of the drivers were operating the motor vehicle while under the influence of an alcoholic liquor or any controlled substance or the combined influence of an alcoholic liquor and any controlled substance; or
    (2) The making of a traffic stop and arrest by a police officer, subsequent prosecution and all other related activities when the driver was operating a motor vehicle while under the influence of an alcoholic liquor or any controlled substance.
